Clearance Terms and Conditions

Allied Petroleum Limited (NZCN 563789) Clearance Product Terms and Conditions 

1.             Introduction

1.1           These terms and conditions (Terms) apply when Customers purchase any clearance products. .

1.2           For the purposes of these Terms:

Allied, us, we or our means Allied Petroleum Limited, a limited liability company incorporated and registered in New Zealand with company number 563789.

Business Day means any day (other than a Saturday, Sunday or public holiday, as that term is defined in section 5(1) of the Holidays Act 2003), on which registered banks are open for business in Christchurch, New Zealand.

Business Hours means 8.30am to 5.00pm during Business Days.

CGA means the Consumer Guarantees Act 1993.

Customer, you or your means any person in New Zealand purchasing the Products from Allied.

Fair Trading Act means the Fair Trading Act 1986.

Order means any purchase submitted by a Customer for the supply of Products.

Privacy Act means the Privacy Act 2020.

Product Supply Terms and Conditions means the Product Supply Terms and Conditions available on the Website, as amended from time to time.

Products means select Mobil Engine Oil products sold on the Website labelled or marked as ‘clearance’.

Personal Information has the meaning given to it in the Privacy Act.

Returns and Replacements Policy means Allied’s Returns and Replacements Policy available on the Website, as amended from time to time.

RRP means recommended retail price.

Shipping and Delivery Policy means Allied’s Shipping and Delivery Policy available on the Website, as amended from time to time.

Website means Allied’s website https://www.m1oils.co.nz/ as updated from time to time.

2.             Acceptance of Terms

2.1           By participating in the purchase, you:

(a)            accept and agree to be bound by these Terms;

(b)            acknowledge that purchasing is conditional on continued compliance with the Terms.

3.             Privacy

3.1           If you choose to purchase, Allied may collect the following Personal Information from you:

(a)            name;

(b)            email address;

(c)            phone number;

(d)            physical address;

(e)            credit card details; and/or

(f)             any other Personal Information provided to Allied through your communications with Allied.

3.2           Allied may collect your Personal Information for the following purposes:

(a)            verify your identity;

(b)            manage and administer our relationship with you;

(c)            provide the Products to you;

(d)            process your Orders;

(e)            invoice you for your Orders and collect any money that you owe us, including authorising and processing credit or debit card transactions;

(f)             communicate with you about the Order, the Promotion, and for general promotions, marketing, and other communications relating to Allied and its products and/or services;

(g)            co-operate with any government, industry, legislative or regulatory authorities;

(h)            protect and/or enforce our legal rights and interests, including by monitoring suspicious or fraudulent activity and defending any claim; and/or

(i)              any other purpose authorised by you or by the Privacy Act.

3.3           Allied will take all reasonable steps to ensure that the Personal Information is collected, used, disclosed and stored in accordance with the Privacy Act.

 

4.             Shipping and Delivery

4.1           Allied will endeavour to dispatch the Products within 48 hours of receipt of an Order during normal Business Hours, from Allied’s Christchurch distribution centre.

4.2           All Orders over the value of $50NZD delivered within New Zealand will qualify for free shipping and delivery, unless you have provided an incorrect or incomplete address in which case, if a second delivery is required, Allied may charge a fee for shipping and delivery.

4.3           Unless otherwise set out in this clause 5, the terms of the Shipping and Delivery Policy apply to the shipping and delivery of the Products. In the event of any inconsistency or conflict between these Terms and the Shipping and Delivery Policy, these Terms will prevail to the extent of that inconsistency.

5.             Returns and Replacements

5.1           Some of the Products may be short-dated, being products with a remaining shelf life of six months or less prior to their expiry date.  By placing an order for the Products, you acknowledge and agree that:

(a)            the short-dated nature of the Products has been disclosed; and

(b)            to the extent permitted by law, such Products are sold on an “as is” basis, and are not eligible for return, exchange or replacement due to their expiry date, except as otherwise required by law.

5.2           Unless otherwise set out in this clause 6, the terms of the Returns and Replacements Policy apply to the return and replacement of the Products. In the event of any inconsistency or conflict between these Terms and the Returns and Replacements Policy, these Terms will prevail to the extent of that inconsistency.

6.             Product Supply Terms and Conditions

Unless otherwise expressly provided in these Terms, the Product Supply Terms and Conditions apply to all Products and Orders. In the event of any inconsistency or conflict between these Terms and the Product Supply Terms and Conditions, these Terms will prevail to the extent of that inconsistency.

7.             Allied’s Warranties and Liability

7.1           Except for any rights you may have under the CGA or the FTA (which cannot be excluded by law), all warranties, conditions, and representations (whether express, implied, statutory, or otherwise) relating to the purchase of clearance products are excluded.

7.2           To the maximum extent permitted by law, Allied is not responsible for any losses, costs, damages or expenses (whether direct, indirect, incidental or consequential) arising from the ordering and purchase of clearance products, including but not limited to:

(a)            change, reduction, suspension, or withdrawal of the clearance offers;

(b)            the unavailability of any Products; and

(c)            any circumstances or events beyond Allied’s reasonable control.

8.             General

8.1           Allied may amend these Terms at any time, and for any reason.  Any changes will take effect immediately upon posting on the Website.  It is your responsibility to review the most recent version of the Terms on the Website before purchasing.

8.2           Allied may cancel all or withdraw clearance products at any time, and for any reason.  While Allied may notify you of cancellations via the Website, it is not obliged to provide direct notifications.

8.3           These Terms are governed by the laws of New Zealand.
